WASA Online Internet and Mobile Payment Services Terms and Conditions

WATER & SEWERAGE AUTHORITY



PLEASE READ THESE TERMS AND CONDITIONS BEFORE USING THE WATER AND SEWERAGE AUTHORITY’S (HEREINAFTER CALLED “WASA”) ONLINE INTERNET AND MOBILE PAYMENT SERVICES (HEREINAFTER REFERRED TO AS “SERVICES”).

BY CLICKING ON “I AGREE” BELOW OR BY USING THE SERVICES YOU CONFIRM THAT YOU ARE LEGALLY BOUND BY THESE TERMS AND CONDITIONS (HEREINAFTER REFERRED TO AS “TERMS AND CONDITIONS”), AS MAY BE AMENDED FROM TIME TO TIME.

BY USING THE SERVICES, YOU DECLARE, CONFIRM AND AGREE THAT YOU HAVE READ, UNDERSTOOD AND ACCEPTED THESE TERMS AND CONDITIONS IN THE SAME WAY AS IF YOU SIGNED A PRINTED VERSION OF SAME AND, AS SUCH, YOU WILL BE BOUND BY THESE TERMS AND CONDITIONS WHICH WILL CONTINUE TO APPLY EVERY TIME YOU USE THE SERVICES.

PLEASE NOTE THAT YOUR INTERNET SERVICE PROVIDER FEES AND YOUR WIRELESS CARRIER’S STANDARD DATA FEES SHALL APPLY. PLEASE PRINT AND KEEP A COPY OF THESE TERMS AND CONDITIONS FOR FUTURE REFERENCE.

  1. In these Terms and Conditions, “we”, “our” and “us” mean WASA, and “you” and “your” mean the individual, firm or entity using the Services.

  1. You must meet and comply at all times with the technical and security requirements that we establish for the Services from time to time.

  1. There exists no contractual arrangement or relationship between us and your Internet Service Provider and/or your mobile or wireless carrier relating to the Services.

  1. By using the Services you agree:

  1. to provide information through electronic means, that is, you agree to provide any relevant information in the format and standard required for each transaction;

  2. that the information supplied by you will be retained in electronic form;

  3. to receive information through electronic means as and when required;

  4. that payments made by you cannot be cancelled;

  5. that any refund which may become payable should follow our existing procedures, which include visiting the nearest Customer Service Centre to log a request; and

  6. to pay a surcharge fee for accessing and/or using the Services.


Notification of Changes

  1. You agree that we can amend, modify, change or replace these Terms and Conditions, the technical and security requirements and/or any of the Services provided under these Terms and Conditions at any time by posting a notice on the WASA Online Internet and/or the WASA mobile payment sign-on page(s) and/or on our website. The new or revised terms and conditions, technical and security requirements and/or services provided under these Terms and Conditions are effective and binding once we notify of such change. If you continue to use the Services after we post the relevant notice that means you agree to and accept the new or revised terms and conditions, technical and security requirements and/or services provided under these Terms and Conditions as amended.

  1. If you do not agree with any amendment, modification, change and/or replacement of these Terms and Conditions, the technical and security requirements and/or the Services, you must immediately stop using the Services and notify us.


Suspension or Termination of the Services

  1. We may suspend or terminate your use of the Services if we believe that you are in breach of these Terms and Conditions or any other agreement(s) that you have entered into with us. If we suspend or terminate your Services, we will notify you. The Services are also subject to termination in the event that your mobile device service terminates or lapses. There are no fees or costs associated with the termination of the Services.

  1. We can discontinue the Services at any time, and notice of such discontinuation shall be posted thirty (30) days in advance on the WASA Online Internet and/or the WASA mobile payment sign-on page(s) and/or on our website.

  1. If you want to disable our access to your accounts on WASA mobile payments, you can do so via the WASA Online Internet or contact us at 868-662-2302/7.


Privacy (applicable to WASA mobile payments only)

  1. You acknowledge and accept that we will partially mask your account number(s). However, balance(s) and other information about your WASA account(s) or credit card account(s) may be included and/or stored on your mobile device. You acknowledge and agree that we will not be liable for any loss that you may suffer, including but not limited to any circumstances under which your mobile device is lost or stolen. You also acknowledge that anyone with access to your mobile device could view its contents, and that you are solely responsible for keeping your information confidential and secure.


Your Responsibilities

  1. It is your responsibility to determine with your wireless carrier if your mobile device is capable of accessing the Internet.

  1. Your ability to access the Services is subject to the terms and conditions of your agreement with your wireless carrier and/or Internet Service Provider. You are responsible for any fees imposed by your mobile service provider and Internet Service Provider of any kind.

  1. You may use the Services for the purposes of making payments to us provided that you do not in any way:

  1. damage or disrupt the operation of the Services; and

  2. use the Services for unauthorized or unlawful purposes.


Our Guarantees

  1. Payments using the Services are made through a secure third party website.

  1. You acknowledge and agree that internet transmissions cannot be guaranteed by us to be entirely secure and/or private, and any information provided by you (including credit card information) may possibly be read and/or intercepted by a third party.

  1. We shall not be liable for the interception and/or hacking of any data or unauthorised access to information provided by you for the purposes of the Services.

  1. You shall abide by the terms and conditions of any agreement you have entered into with us which govern your use of the Services and you shall follow any of our guidelines accordingly.

  1. You shall always keep private and confidential (a) your password and credit card security code number (last three italicized numbers printed on the back of your credit card), and (b) the answers to any online security questions you have chosen that allow you to access the Services. You should not divulge such information to anyone, including but not limited to family members, friends, employees, accountants, bookkeepers or any other persons or entities. You should not write such information down or keep a poorly disguised record of the information or save the information in your mobile device.

  1. You shall notify us immediately in the event of loss, theft or misuse of your password, mobile device or WASA mobile payment session. You may contact us at 868-662-2302/7.

  1. You should not respond to text messages, pop-ups, emails or other internet requests that ask you to reveal personal information about yourself or your WASA account(s).

  1. We will never send you unsolicited text messages or emails asking for your password, credit card information, account numbers or such other personal or confidential information. We will never ask you to validate or restore your account or your access to the Services through unsolicited text messages or emails.

  1. You must review your statements and report any errors in a timely manner. Different transactions have different reporting timelines. You may view the applicable account agreement statement for further details.

  1. You agree to assist us in any investigation(s) relative to improper access of your account(s).


Limitation of Liability

  1. To the fullest extent applicable under the law, you agree that neither we nor any other third party associated with provision of the Services shall be liable to you or any other person or entity for any direct or indirect, special, consequential, exemplary or punitive damages or for any losses arising out of or in connection with your use of the Services or your inability to receive or use the Services, regardless of the cause of the damage or loss, including (but not limited to) negligence, even if we (or such third party) are notified of the possibility of such damages.

  1. We provide the Services as a convenience to you. The information contained on our various web pages does not constitute an official record for the WASA account(s) to which it pertains.

  1. The Services are subject to the agreements you have in place for the products and services that you have with us.


Conflict Resolution

  1. If there is any conflict (relating to the Services) between these Terms and Conditions and any other agreement between you and us, then these Terms and Conditions shall prevail to resolve the conflict.


Indemnification

  1. You agree to indemnify us from and against all loss, damage, costs and expenses suffered or incurred as a result of any breach of these Terms and Conditions by you, your servants and/or agents and/or any other person authorised by you to use the Services.


Governing Law

  1. These Terms and Conditions will be governed exclusively by the laws of the Republic of Trinidad and Tobago. You agree that the courts of Trinidad and Tobago shall have jurisdiction for the determination of any matters arising out of these Terms and Conditions.
